Introduction
Welcome to TotesofJoy.com! These are general terms and conditions of use (“Terms of Use”) governing your access and use of the websites and mobile applications owned and operated by TotesofJoy.com. Your use and ability to register for use of this site and services (defined below) constitute your acceptance of the Terms of Use and Privacy Policy. Please do not continue to use or access this site or services if you do not agree with these Terms of Use. This document is a legally binding agreement between you as the User(s) of the site (referred to as “Customer”, “you” or “your” hereinafter) and TotesofJoy.com (Referred to as “we”, “us”, “our” or “TotesofJoy.com” hereinafter).
Protect Your Account
When you register on the Site and set up an account, you'll need to set a password. It's your responsibility to keep your password safe and ensure that no one else, except you or those you authorize, uses your account. You commit to protecting your password and agree not to hold TotesofJoy.com responsible for any losses if someone else accesses your account due to your negligence in safeguarding your password.
Delivery Of Order(s)
TotesofJoy.com commits to delivering food items to you and your families according to the terms specified in this agreement. We shall, at our own expense, package, load, and deliver your Order(s) to the Delivery Point using the information on the invoice, delivery terms, and other instructions printed on the Purchase Order or otherwise provided to TotesofJoy.com by you in writing. No charges will be allowed for transportation, insurance, shipping, packaging or similar charges unless provided for in the applicable Purchase Order or otherwise agreed to in writing by you.
Time is of the essence with respect to delivery of your Order(s). Orders should reach you by the specified Delivery Date. TotesofJoy.com will promptly notify you if we are unable to meet the delivery date as expected. You may at any time prior to the Delivery Date, upon notice to us, cancel or change the purchase order, or any portion thereof, for any reason, including, without limitation, for your convenience or due to failure of TotesofJoy.com to comply with this Agreement, unless otherwise noted.
All orders are subject to the customer's right of inspection. Customers have a 2-day "Inspection Period" after the delivery of the orders at the Delivery Point. During this time, customers can either accept or reject the orders. Customers have the right to reject orders that exceed the quantity ordered, are damaged or defective, or do not meet the specifications or terms of the Agreement. If any orders are rejected, customers need to notify TotesofJoy.com within the Inspection Period with the reasons for rejection. Failure to provide notice of rejection within this period will be considered as acceptance of the orders by TotesofJoy.com.
You shall be entitled to return rejected Orders to TotesofJoy.com on the basis that the products aren't used, undamaged in its original packaging and condition for replacement. We shall not deliver Orders that were previously rejected on grounds of non-compliance with this Agreement, unless delivery of such Orders is approved in advance by the Customer, and is accompanied by a written disclosure of customer's prior rejection(s) through Support@totesofjoy.com.

Complaint
If you have sent a notice, you can file a complaint within 3 months after being informed of the decision following your notice. You can submit your complaint using the form available at the "Help Center." TotesofJoy.com will notify you of our decision regarding the information related to the complaint. PLEASE NOTE THAT IF YOU FREQUENTLY SUBMIT NOTICES OR COMPLAINTS THAT ARE CLEARLY UNFOUNDED, TOTESOFJOY.COM MAY, AFTER ISSUING A PRIOR WARNING, SUSPEND THE PROCESSING OF YOUR NOTICES AND COMPLAINT.
Donation
This agreement covers both you and us for the service we offer and any donation you plan to give. It's important to carefully go through the terms in this agreement and ensure you grasp them fully before using any of our services or making a donation. When you donate, you are agreeing to the terms and conditions outlined in this agreement.
For every 10 totes you buy, TotesofJoy.com donates 1 tote to a family in need in Ghana. This extra tote isn't part of your purchase, but the proceeds from your totes help with this donation. You can also choose to donate a tote through our mobile app or pick a specific household by providing their address. We value your privacy and ensure it's protected when you donate through our system. We take extreme care to process your donations; however, in case of an unlikely event of an erroneous donation, please reach out to our customer service at Support@totesofJoy.com.

Confidentiality
TotesofJoy.com shall safeguard and keep confidential any and all information relating to you obtained by it or provided to us by you in connection with this Agreement and shall use such information only for the purposes of carrying out its obligations under this Agreement.
Limitation of Liability
TOTESOFJOY.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR WEBSITE OR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION. IN STATES OR JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR SUCH DAMAGES IS NOT ALLOWED, TOTESOFJOY.COM'S LIABILITY WILL BE RESTRICTED TO THE EXTENT PERMITTED BY LAW.
Miscellaneous
The Terms, excluding any other agreements, are the complete agreement between you and TotesofJoy.com regarding your use of the sites and services, replacing any previous written or spoken agreements on the same subject. If any part of the Terms is found to be invalid or unenforceable, that part will be removed, and the rest of the provisions will remain valid and enforceable by TotesofJoy.com.
